Justices Doubt Colorado Rules for Catholic Schools

Colorado offers 15 hours a week of publicly funded preschool, but schools taking the money must enroll every child regardless of sexuality or gender identity, and Catholic schools say that's a hard pass. At Tuesday's arguments, Justice Barrett asked Colorado lawyer Helen Norton to explain the difference from the 2022 Carson precedent. Bless her heart, that's the legal version of asking who ate the last biscuit. Becket, which represents the Archdiocese of Denver, backed the schools, while Justices Barrett, Roberts and Kavanaugh raised doubts about the state. Only the three liberal justices suggested Catholic schools wanted a special accommodation, which is what the left calls religious freedom when it's somebody else's to give. I run a business and raise kids, and I know a rule written by people who never have to enforce it.
